Income Taxes - You're not stupid...are you?

How can you think that your income is taxable?

If you were born in the United States of America, and you are sending half of your pay to Washington D.C. because you think that you must according to law. Well... you don't really know much about your rights under the law...and what you think and believe about things that you really don't know about is costing you your future.

But, the fact that you are here shows that you are thinking, and thinking to question, that is a good thing. Because even though you have been told what to think, and taught to believe without question, you still know that you have not... the truth.

The truth is, that you give your authority to government through the Constitution. The Constitution severely limits the lawful jurisdiction of federal government. The federal government is authorized to tax only those under its jurisdiction.

This was perhaps stated best in Caha v. United States, 152 U.S., at 215, where the Supreme Court stated:

"The laws of Congress in respect to those matters do not extend into the territorial limits of the states, but have force only in the District of Columbia, and other places that are within the exclusive jurisdiction of the national government."

These are the people that have NOT been able to refute this reality.

  • Do you believe that you are "required" to pay taxes on your income to the federal government??

How could that possibly be? The federal government has no jurisdiction in regard to you if you live within one of the fifty states. Sure, they'd like you to think that the federal government rules all, but it just plain isn't so. This is the reason that we declared Independence from Britain. That government was running all over the rights of the American states. Just like our federal government does today. The people, and their states, are separate from the jurisdiction of Washington D.C. Our Constitution spells this out clearly.

As long as you believe that the federal government "rules all", then the federal government will just assume the jurisdiction that you are granting through your "belief" and take just as much money as it can get from you. But, it is only your "belief" that is making it possible, not any lawful requirement.

The federal income tax has been defined by the U.S. Supreme court as an excise tax.

Flint v. Stone Tracy Co., 220 US, 110 (1911) 

"Excises are taxes laid upon the manufacture, sale and consumption of commodities within the country, upon licenses to pursue certain occupations and upon corporate privileges; the requirement to pay such taxes involves the exercise of the privilege and if business is not done in the manner described no tax is payable...it is the privilege which is the subject of the tax and not the mere buying, selling or handling of goods."

So then, what is the privilege that only our courageous leaders in Washington can grant. What privilege does government grant to you that requires such lofty tribute that you owe half of your paycheck? The federal income tax is legally applicable to all of those people, subject to federal jurisdiction, who are exercising a federally granted privilege to earn income. Does that include you? Are you an alien working in the U.S. by permit? Did you get a federal license to work in your trade or profession?

Your sovereign citizenship is a right of birth, not a privilege granted by the federal government. The federal government is subject to your authority expressed by the Constitution and your representatives in Congress.

The truth is, that if you were born and reside in one of the 50 states that are party to the Constitution, you are outside of federal jurisdiction. Your earnings are a matter of right, not the result of privilege. In this status, you are not lawfully obligated to comply with federal income tax law. Doing so would be like paying California's sales tax on items you buy in your Michigan neighborhood. You can, but, you don't have to.

These are the people that have NOT been able to refute this reality.

  • Do you believe that you "must" have money withheld from your pay for income taxes and Social Security??

The truth is easy here. If withholding were lawfully "required", your employer would not need your authorization to do so. If law required your employer to withhold, that same law would authorize your employer to do so. The fact that your employer needs you to sign a W-4 form is proof that there is no other authority for withholding except for yours. Your employer cannot lawfully withhold without your signature and authority to do so. That is why the term is "voluntary compliance".

When you "volunteer" by signing the forms, you waive your Constitutional status and enter federal jurisdiction. Thereby authorizing and volunteering for the income tax code to be applied to you. This is why the IRS admits that they are dependent on "voluntary compliance". You must first join the Army in order to be subject to the jurisdiction of the Army. It is the same with the IRS and their tax code, you are volunteering to be subject to its jurisdiction.

The IRS will let you believe that you must volunteer, if that is what you believe. But, even that agency will never state that a law requires your compliance. You would be correct to assume there is no such law, rather then assume that it is being hidden from view.

  • Income Tax Freedom - There for the having

Uncle Sam Needs YOU! You are needed to declare yourself a federal/subject/taxpayer. You are needed to make the determination that you should apply the income tax code to yourself. You are needed to authorize the collection of tax on your income. Because without your authority, Congress has none when it comes to taxing your property.

The other side of this is that when you don't do any of these things, you are free from income taxation. April 15th is just another spring day. And, you don't work half of the day to prop up Washington D.C.'s ever failing social programs.

When you do not subject yourself to the jurisdiction of Congress, your income belongs to you. It is your property to do with as you please. Your Constitution reserves this right to you, and it has been in effect for over two centuries. It is the ultimate shelter against the tyranny and whimsy of weak and spineless politicians who would seek to buy votes with your money.

Having income tax freedom involves standing on and invoking your Constitution. It requires a belief and holding with the Declaration of Independence that freedom is the natural condition and unalienable right of mankind. Thousands of couragous people have laid down their very lives so that Sovereign rights would be inherent to you.

  • What are you afraid of??

The men that boarded the Beaver to put the tea in Boston Harbor had to think about being drawn and quartered if they were caught. The magnificiently defiant 56 signors of the Declaration of Independence were subjects of the british crown and had signed their death warrant, had the crown prevailed.

They, the true founders, set aside fear to pledge their lives, their fortunes, and their sacred honor... not in the hope that permission would be granted. They did so with firm resolve to win independence no matter the cost. For many, the cost was high. Many lost their lives, many lost their sons, many lost their lands, many never enjoyed the fruits of liberty.

The Continental Army was made up of rag-tag militias manned by some soldiers and more farmers, merchants and fishermen. They loaded their rifles one ball at a time, wrapped their feet in rags when there were no boots, and endured hardships that you and I can not imagine. While they fought against better equipped, better trained, and supposed superior forces, in the hope of enjoying something they had never known, freedom.

Now, while you may think that all of that is not relevant in these modern times, I say... look or think again. The battle for your freedom has already been won. Your independence and unalienable rights are not just a gleam in a colonists eye. These concepts are undeniable truths established and proven by the courage and blood of our forefathers.

They did not have independence, so they took courage to declare it, then they suffered the hardship of war for 7 years to win it. Many thousands have defended it through the centuries... will you stand up for it today??

Because that is all that you have to do to enjoy the benefits of freedom. Stand upon the Constitution of the United States of America and you stand with all of those that have gone before. Their will, their faith, their wisdom stand with you and empower you against the tyranny that is today's federal government. Will you take courage to secure the blessings of liberty for the future generations of America?
